Terms of Service

1. Acceptance of Terms

By accessing or using AI Speakly (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These Terms apply to all users, including customers, trial users, and visitors.

2. Description of Service

AI Speakly provides a CRM platform for real estate investors, including AI voice agents, pipeline management, automation workflows, deal analysis tools, and related features. The Service is provided on a subscription basis. Features and pricing are subject to change with reasonable notice.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Subscription and Billing

Access to the Service requires a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Authorize us to charge your payment method on a recurring basis
  • Notify us of any changes to your payment information

The one-time setup fee is non-refundable once setup work has commenced. Monthly subscription fees are charged at the beginning of each billing period.

5. Cancellation

You may cancel your subscription at any time by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months of service. Upon cancellation, your access to the Service will terminate at the end of the paid period.

5a. Refund Policy

Refunds are evaluated on a case-by-case basis and may be issued under the following conditions:

  • Good Faith Effort — The subscriber has demonstrated a good faith attempt to utilize the platform and its features as intended. A good faith attempt is defined as the investment of reasonable effort, capital, and time necessary to achieve results using the system. Benchmarks used to evaluate good faith effort are based on industry standards relevant to the subscriber's use case. For example, in the case of inbound pay-per-lead (PPL) campaigns, industry benchmarks may include approximately 25 leads, a minimum of 2 hours of daily talk time, consistent follow-up activity, and timely closing practices. Similar benchmarks will be applied based on the applicable strategy.
  • System Malfunction — A verifiable system malfunction has occurred that materially impacted the subscriber's ability to use the platform, and the issue was not resolved within 10 business days of being reported.

Refund requests that do not meet either of the above conditions will not be approved.

5b. Important Disclaimers

AI Speakly is a CRM platform equipped with advanced technology designed to assist with deal flow and sales operations. AI Speakly is not a lead provider and makes no guarantees regarding the quality, volume, or conversion rate of leads flowing into the system from third-party sources. All systems and capabilities are made available immediately upon signup.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations, including TCPA, CAN-SPAM, and applicable state telemarketing laws
  • Send unsolicited communications to individuals who have not consented
  • Harass, abuse, or harm any individual
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse engineer, decompile, or disassemble the Service

7. Telephone Consumer Protection Act (TCPA) Compliance

You are solely responsible for ensuring your use of the Service's calling and messaging features complies with the TCPA and all applicable federal, state, and local telemarketing laws. This includes obtaining proper consent before placing AI calls or sending SMS messages. AI Speakly is a technology platform and is not responsible for your compliance obligations.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by AI Speakly and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of all data and content you input into the Service. You grant us a limited license to use such data solely to provide and improve the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI SPEAKLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless AI Speakly and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
